    No, they only become Returning Officer once the previous RO has transmitted to Congress that they are no longer interested under the Twenty Fifth Amendment. Until then, they are the Acting Returning Officer. There was a court case, Rex vs Gordon Brittas that eventually decided it.

    The official responsible for elections is usually the High Sherriff- the folks with the feathers. The person who actually does the work is usually the Chief Executive and is appointed Acting RO or Deputy, depending.

    Returning officer is the lord mayor or whatever, while the acting does the actual work.
