The prime minister was sent a “very lengthy” report by Adam Tolley KC early yesterday morning but by the evening was still undecided over whether to keep Raab in his cabinet.
Raab, the deputy prime minister and justice secretary, was also sent a copy of the report and is said to be “confident” he will be exonerated. He believes the report does not show that he breached the ministerial code and will not be offering his resignation, although he has not yet spoken to the prime minister.
Officials who have seen the report, however, believe that it is “terrible” and think Raab should be sacked. There are also concerns that keeping him in post will be damaging for relations with the civil service.
Retaining Raab would mean he continues working with officials he knows have made formal complaints about him. It would also be particularly difficult for Antonia Romeo, permanent secretary at the Ministry of Justice, who is understood to have twice warned him about his behaviour after officials made complaints.
Senior civil servants have prepared briefing packs for new government ministers in the event that Raab is sacked today and there is a reshuffle.

However, if as is stated he has made people cry because he has ripped the shit out of the quality of work they have produced for him, then good for him. He is at the top of Government. He has a right to expect the very highest quality briefing materials to be available to him. If somebody too junior is put in harms way, that is the fault of the Civil Service. Our top Ministers should not be getting work experience snowflakes briefing them. If he makes Malcolm Tucker look like Mary Poppins, then the Civil Service should expect that - and man up accordingly.
