There are customs checks now. Gibraltar is outside the customs union.

It would have been bad PR to exclude them, and they could be relied on to stir up the Tory press if they were ignored. They didn't get a vote in 1975, incidentally.
The major European powers (including the UK) just agreed to set up a special purpose vehicle to facilitate trading free of US sanctions with Iran. Could we do something similar with Gibraltar/Ireland...?
