    This feels like a massive miscarriage of justice.

    A lawyer from Aberdeen has been found guilty of dealing nearly £87,000 worth of ketamine.

    Amanda Lothian, a criminal defence lawyer who specialised in organised crime, had her house raided by police in August 2020, during the pandemic.

    Officers, aided by a sniffer dog called Buster, searched the 65-year-old lawyer's house and Volvo and discovered around £72k worth of Ketamine in two bags - enough Cat Valium to sedate not just a clowder of cats, but a family of elephants as well.

    Never previously heard of the term 'cuckooing' but it fits perfectly the crime I once heard as a juror. The accused had gone to work leaving his front door open deliberately, and according to him, in order to allow his dog access to the landing outside the flat. By chance, the premises were visited by the police who found a stash of counterfeit £20 notes secreted in some shoe boxes.

    We the jury accepted it was probable he knew nothing of the money, but we agreed it was near certain that he knew the place was being used for illegal purposes. He was charged with 'handling', although it is unlikely he ever touched the stuff. We thought him guilty as f*ck anyway and weren't prepared to let him off on a technicality.

    It would have been hepful if the term cuckooing had been mentioned during the trial, or even known by any of us at the time, because it describes perfectly what we thought was going on there.
    If he was complicit in the activity, then it's not really cuckooing. Cuckooing is when someone takes over having inveigled their way in.

    Understood, but it's a helpful concept when thinking about the crime of allowing someone to use your flat/car/office to do something illegal but 'don't tell me about it, so I can plead innocence'.

    I suppose in the case we heard, the accused was effectively arguing he had been cuckooed, whereas the jury concluded that he had colluded, implicitly or otherwise.

    That's just "art and part" in Scotland or aiding and abetting in E&W. I would guess there are lots of cases where it's very difficult to make a determination.

    Never previously heard of the term 'cuckooing' but it fits perfectly the crime I once heard as a juror. The accused had gone to work leaving his front door open deliberately, and according to him, in order to allow his dog access to the landing outside the flat. By chance, the premises were visited by the police who found a stash of counterfeit £20 notes secreted in some shoe boxes.

    We the jury accepted it was probable he knew nothing of the money, but we agreed it was near certain that he knew the place was being used for illegal purposes. He was charged with 'handling', although it is unlikely he ever touched the stuff. We thought him guilty as f*ck anyway and weren't prepared to let him off on a technicality.

    It would have been hepful if the term cuckooing had been mentioned during the trial, or even known by any of us at the time, because it describes perfectly what we thought was going on there.
    That's not cuckooing, if you thought this individual had some agency. It's typically a highly vulnerable person who is taken advantage of to facilitate crime.

    (And I think you've just admitted to finding someone guilty of a crime you thought they didn't commit... not a big fan of that, might be worth a clarification)
    The term cuckooing certainly fits in that the counterfeiters were using someone else's premises for their own purposes. The extent to which the resident at the 'nest' was vulnerable is an open one. I should say that on the whole he was not. His complicity seemed fairly obvious, vulnerable or not.

    The jury didn't convict him of a crime he didn't commit. It may have taken a broad view of what constituted 'handling'. It may also have favored substance over form. Either way I believe the jury acted well within its remit.
    Ok - just be aware that in police vocabulary, the taking of advantage of someone is the key component of "cuckooing". In drama, there are some good examples of it in Happy Valley.

    I don't know enough about what "handling" means to know whether that was an appropriate decision. I hope you understand why I was a bit concerned!
    Oh, I understand completely, Eabhal, and so did the jury at the time. There was a lot of healthy discussion about this before a verdict was agreed.

    In fact my biggest take away from my time as juror was that the smarter the jury, the less likely the guilty would get off. It was this geezer's misfortune to have a very smart jury hear his case.

    i sat on another case where a not guilty verdict was returned parlty because most of the jurors were extraordinarily stupid and concerned mainly with getting home early. The Judge's remarks when the verdict was returned made it plain we had erred.

    Far too many people are totally inconsiderate, or even thrive on upsetting others. This is just one manifestation. They think they can act with impunity - well it is time to sort the feckers out.
    Or we could invest in things like surestart and youth clubs to actually change the next generations behaviour rather than come up with more new laws that will be very rarely enforced.
    Sterilising the current generation of vermin would prevent the next from arising.

    The constant outrage at every crass, stupid, unamerican, thing Trump did was also a feature of his last Presidency. Some of it was no doubt valid, but looking back on the period, it was actually rather benign by comparison to what came before and since - certainly from a British perspective. This term may well turn out the same.

    Back in 2016, just after he was elected, I made the point that the change he made in the US would not be sudden, but gradual. And it was. His first presidency was far from benign, and this one is proving to be positively hostile.

    That is not good for this country. Trump is not good for this country. Heck, he's not even good for the USA.

    Now, there may be opportunities for the UK in what he is doing, but even then we are also losing a heck of a lot in the process, and the world will be much more uncertain and dangerous place. You may like that danger and uncertainty, but I'd suggest that it would be silly to do so.

    It's interesting that whenever *DS is first used - whether it is Musk Derangement Syndrome, Trump Derangement Syndrome, Boris Derangement Syndrome etc - the people saying it are proved wrong, and the people who are supposed to be 'deranged' are actually correct, as they were in those cases.

    So if I were you, I'd be careful about narcissistically creating a Derangement Syndrome about yourself, because the people you accuse of it are probably right... ;)

    The constant outrage at every crass, stupid, unamerican, thing Trump did was also a feature of his last Presidency. Some of it was no doubt valid, but looking back on the period, it was actually rather benign by comparison to what came before and since - certainly from a British perspective. This term may well turn out the same.

    She's in the game accepting organised criminals and druglords as clients. If she wants to profit from the misery her clients create then she's got to live with the consequences of their actions and irresponsibility. Did she think she was somehow immune to the law?

    I'd be really interested in a transport breakdown by voting intention. I reckon train commuters in the SE must be a key Tory/LD battleground.
    I can't imagine choosing a party on the basis of their stance on people playing music on the train, though I agree it's a minor nuisance. But TBH that's true of an awful lot of local issues. One leaflet in my area (I'll be discreet about the source) focuses on access to a supermarket carpark - you might get delayed by a whole minute, shock horror. Another vaguely calls for "some investment" in local services when new housing is built. Is it odd that turnout at local elections is typically under 50%?
    Minutes do actually add up. The idiots in my local council* have decided to make a moderately dangerous junction on my way to work considerably more dangerous by adding traffic lights - just over a bind brow (There has already been at least one accident since they put up temporary lights a month or so ago to do the work!). I realised that if it averages out to a minutes delay each way a day (plausible), I'll waste over a working day a year sat there.

    *This is the same bunch of morons who are currently spending 3 millon quid putting averaging cameras and a 50 limit on a different part of my route to work they've decided is dangerous, despite all their published evidence making it quite clear it isn't - it doesn't even meet the threshold for the road signs to have yellow backgrounds. The supposed crisis in local goverment funding is clearly imaginary, the actual crisis is that their money gets spent on the wrong things, often because it arrives as ringfenced grants.

    There is a limit of one image per day.

    You guys have repeatedly broken this limit which leads to images being shrunk as a result, please stick to the limit or the ability to post pictures might be removed.

    Can I ask for one clarification please, @TSE ?

    The last time I can recall posting two images in a day (which was probably 7-10 days ago), one was a quote from a thread the previous day.

    Is this a problem for the system?
